Resolved, That, inasmuch as neither Mr. Todd nor Mr. Jayne, claimants William Jayne, having presented a certificate, in due form of law, of his election as delegate from Dakotathe Territory, a of Dakota to the 38th Congress, admis entitled to take the oath of office and occupy a seat in this House, neither of as such delegate, without prejudice to them be sworn now, but the whole subject be refer rights of J. B. S. Todd, claiming to be duly elected thered back to, the Committee of Elo prosecute his contest therefor, a repccording t upon the meritrules and usages of the cais House.
