Resolved, That the election in the Territory of Dakota for delegate was attended with so much illegality and fraud, that neither William Jayne nor J. B. S. Todd is entitled to a seat in this house as such delegate, and the seat of the delegated from that Territory is declared vacant..

Resolved, That J. B. S. Todd is entitled to a seat in this House as a delegate from the Territory of Dakota in the 38th Congress.
