Thomas A. Jenckes and Nathan F. Dixon from Rhode Island enter the House; The contested-election cases of Smith vs. Brown and Trimble vs. Symes are submitted to the House
Whereas there is good reasonResolved, That John D. Young, claiming to believe that inone of the members-election recently held in to this House from the State of Kentucky for Representatives, be not permitted to the Fortieth Congressbe sworn in as such member, but that the legal and loyal voters incredentials of said John D. Young, together with the several districts inprotest of Samuel McKee and other citizens of said State accompanying the affidave been overawed and prevented from a true expression ofits, be referred to the Committee of Elections; and that the said committee be instructed to investigate and report on their will charges and choice at the polls by those whfacts of the case, and whether said Young is entitled as a loyal citizen to have sympathized with, or actually participated in the late rebellieat in this House; and that the committee have power to take testimony, and for that such electipurpose to send for persons and papers.
And whereas it is charriged by the votesa member of such disloyal and returned rebels; and wherthis House that J. Proctor Knott, who claims a seas it is alleged that severas a member from the fourth district of Kentucky, was disloyal tof the RepresGovernmentatives–elect ofrom thate United State are disloyal.
s during the rebellion: Therefore,
Be it further resolved, That the credentials of Lawrence S. Trimble, John Young Brown, J. Proctor Knott, A. P. Grover, Thomas L. Jones, James B. BeckMr. Knott be also referred to the Committee of Elections with instructions to inquire into such disloyalty, with power to send for persons and papers.
Resolved, That Lawrence S. Trimble, and John D. Young Brown, claiming to be members-elect of this House from the State of Kentucky shall, be referrnot permitted to the Committeebe sworn in in as such members; but that the credentials of Electionssaid Lawrence S. Trimble and John Yong Brown, to report at as early a day as practicablgether with the protests of G. G. Symes and Samuel E. Smith, and of other citizens of said State, and pendthe accompanying thaffidavits, be reportferred to the Committee of Elections; and that the said committee be instructed to investigate and report of said membn the charges and facts of the case, and whethers shall be allaid Trimble and Brown are entitled as loyal citizens to take the oath of office and admittedseats in this House; and that the committee have power to take testimony, and for that purpose to seats as suchnd for persons and papers.
