A Proposition To Be Inserted in the Constitution Water and Water-Rights, By Lycurgus Johnson of Uintah Co.
Section 1. The waters of all natural sources of supply shall be under the control of the state for the use and benefit of its citizens.
Section 2. No law shall be passed to take away or impair any lawful acquired rights, except in case of non-user or abandonment as prescribed by law.
Section 3. The supervision and distribution of the waters from natural sources shall be under the control of the county commissioners for their respective counties of the state; and all disputes in relation to the use of water shall be first submitted to and determined by the county Commissioners; its decisions to be subject to review by the courts of this state, as may be prescribed by law.
Section 4. The legislatures may also provide for the appointment of a state engineer, to have a general supervision of the waters of the state, and of the county commissioners in the discharge of their duties connected therewith. The qualifications, duties, powers and compensation of such engineer to be prescribed by law.
