Joint Resolution

Proposing an amendment to the Constitution of the United States.

Be it resolved by the Senate and House of Representatives of the United States of America in Congress assembled, (two thirds of both Houses concurring,) That the right, to vote, to be voted [+e867079]for, and to hold office shall not be denied or abridged anywhere in the United States under any pretense of race or color; and all provisions in any State constitutions or in any laws, State, territorial, or municipal, inconsistent herewith are h[+e867079]llowing article be proposed to the Legislatures of the sev[-e867079]ereby decl[+e867079]ared nul[+e867079]l and void. Sec. 2. That any person who, under any pretense of race or color, willfully hinders or attempts[+e867079]States as an amendment[-e867079] to hinder any citize[+e867079]the Constitutio[-e867079]n of the United States from being registered[+e867079], or from voting, or from being voted for, or from holding office[+e867079]which[-e867079], or [+e867079]who attempts by m[+e867079]enaces[+e867079] to dete[+e867079]r [+e867079]any such ci[+e867079]tizen from the exercise or enjoyment of[+e867079]fied by[-e867079] thre[-e867079]e right[+e867079]fourth[-e867079]s of citizenship above mentioned[+e867079]said Legislatures[-e867079], shall be punis[+e867079]hel[-e867079]d by[+e867079] a fine not les[+e867079]s than $100 nor more than $3,000, or by imprisonment in the common jail for not less than thirty days nor more than one year[+e867079]part of said Constitution, namely: [-e867079]

Sec. 3. That every person legally engaged in preparing a register of voters, or in holding or conducting an election, who willfully refuses to register the name or to receive, count, return, or otherwise give the proper legal effect to the vote of any citizen under any pretense of race or color,[+e867079]1. [-e867079]No discrimination[+e867052 -e867079] shall be [+e867052]punished by a fine not less than $500 nor more than $4,000, or by imprisonment[+e867079]made[+e867052 -e867079] in [+e867052]the common jail for not less than thre[+e867079]any Stat[+e867052 -e867079]e [+e867052]c[+e867079]a[+e867052]lendar [+e867079]mon[+e867052]ths nor more than two years. Sec. 4. And be it further enacted. That the district court[+e867079]g the[+e867052 -e867079]The righ[-e867079]t of[-e867052] any [-e866904]citizens[+e866904] of thshall hav[+e867079]e Uni[-e867079]ted clusive jurisdiction of all[+e867079]Sta[-e867079]in [+e867052 -e867079]the[+e867052]fenses against[+e867079] ex[+e867052]is act; and the district attorneys, marshals, and deputy marshals, th[+e867079]ercise of the elect[+e867052 -e867079]iv[+e867052]c[+e867079]e[+e867052]mmissione[+e867079] [+e867052]s[+e867079]f[+e867052]appo[+e867079]ra[+e867052]ted by[+e867079]nchis[+e867052]ci[+e867079]e[+e867052]cu[+e867079]t[-e867052]es[-e867079] t[-e867052]and terri[+e867079]o [-e867052]rial[+e867079]v[-e867052]court of t[+e867079]o[-e867052]e United States, with powers of arresting, imprisoning, [+e867079]t[-e867052]r bai[+e867079]e[-e867052]ing offen[+e867079] [-e867052]ers, and every other[+e867079]and hol[+e866904 -e867052]r specially empowered by the President of the Unitedi[+e867079]d offic[+e866904 -e867079]e [+e866904 -e867052]shal[-e867052]s, shall be, and they are hereby[+e867079]l not be denied[-e867079]in[+e867052 -e867079] o[-e867079]r [-e867052]abri[-e867079]d[-e867052]equired[+e867079]ge[-e867052]at the expe[+e867079]dse of the United St[+e867079] bes, to institute[+e867079]y [-e867079]righ[+e867052 -e867079]t to[+e867052]ceedings against any [+e867079] ho[+e867052]son who violates this act, and cause him to be arrested and impris[+e867079]ld office i[+e867052 -e867079]n[+e867052]t[-e867052]ed or bailed[+e867079]he[-e867052]as the case may be, f[+e867079] Un[-e867052]trial before such court as by this act has cognizance of the offense[+e867079]ited [-e867079]Stat[-e867052]n[+e867038 -e867052]es[-e867052],[+e866904 -e867052] o[-e867052]5. And be it further enacted, T[+e867079]r[-e867079] by[+e866904 -e867079] any State[-e867079], o[+e866904 -e867079]n [+e866904]t every citizen unlawfu[+e867079]ac[+e866904]y deprived of any of the rights of citizenship secured[+e867079]count[+e866904 -e867079] by reason of[-e867079]nati[+e867052 -e867079]vity[+e867052]this act under any [+e867079], [+e867052]etense of race or color may maintain a suit against any person so depriving him, and recover damages i[+e867079]property, educa[+e867052 -e867079] race,[-e867052]district court[+e867079] color[-e867079],[+e866904 -e867079] or[-e867079] [-e867052]prev,[+e867052]e United States for the district in which such person may be found[+e867079]io[-e867079]r creed[+e867052 -e867079]u[-e867079]s conditio[-e867052]n of slav[-e866904]ervitude[+e866904]y of any citizen or class of citizens of the United States[-e866904].

Sec. 2. The Congress shall have power to enforce by proper legislation the provisions of this article.
