A Bill

To amend the act passed March 23, 1867, entitled "An act supplemen[+e866361]facili[-e866361]tary [+e866361]to an act to provid[+e866361]e for [+e866361]the mo[+e866361]re efficient government[+e866361]storation[-e866361] of the late [-e866361]rebel States,” passed March 2, 1867,[+e866361] and to [+e866361]facilitate the rest[+e866361]oration[+e866361] o[-e866361]thereof[+e866361] purposes[-e866361].

Be it enacted by[+e866343]Whereas, since[-e866343] the Senate and House[+e866343]organization[-e866343] of Rep[+e866343]resentati[+e866343]volutionary State go[-e866343]vernment[-e866343]s of[+e866343]in[-e866343] the United[+e866343]late rebel[-e866343] States of America in Congress assembled, That so much of the fifth sec[+e866343]labama, Arkansas, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Texas, and Virginia, no constitu[-e866343]tion of an act passed March 23, 1867, entitled “An act supplementary to an act[+e866343]al State governments have existed in said States; and whereas the Congress of the United States failed[-e866343] to provide by law [-e866343]for the re[-e866343]more effici[+e866343]val of disloyal men now administering said illegal or pret[-e866343]ended Sta[-e866343]te[-e866343] government of[+e866343]s; and whereas[-e866343] the rebel[+e866343]government of the United[-e866343] States, passed March 2, 1867, and[+e866343] cannot recognize the right of men[-e866343] to facilitate their restoration," as requires that a majority[+e866343]hold office, even under a provisional or temporary government, who cannot take the oath[-e866343] of all th[+e866343]offic[-e866343]e p[-e866343]registered votes of th[+e866343]scribed by law: Therefore, [-e866343]

B[-e866343]e d[+e866343]istric[+e866343]t shall[+e866343]enacted[-e866343] by th[-e866343]e cast in favor[+e866343]Senate and House of Representatives[-e866343] of the ratification of[+e866343]United States of America in Congress assembled, That[-e866343] the constitu[+e866343]ven[-e866343]tions which have[-e866343] bef[+e866343]en, [-e866343]ore[+e866343] wh[-e866343]ich may hereaf[-e866343]ter[-e866343] becomes vali[+e866343], elected, convened, and organize[-e866343]d in either of the late re[-e866343]bel States of Alabama[-e866343], Ark[-e866343]and the same is hereby, so far modifi[+e866343]sas, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Texas, and Virginia, as provid[-e866343]ed in [-e866343]the [-e866343]ac[-e866343]t a majority of[+e866343]of March 2, 1867, and[-e866343] the votes cast at[+e866343]several acts supplementary[-e866343] the election for[+e866343]reto, be, and[-e866343] the ratification or rej[+e866343]y are hereby, author[-e866343]ized to elect by ballot a provisional governor and an executive council of [-e866348]the Constitution shall b[+e866343 -e866348]six competent citizens, to administer, in such manner as the con[-e866348]sidered as valid and as affirming or reject[+e866343 -e866348]vention electing them may prescribe, the provisional governments in each of said States, during the con[-e866348]s[+e866343 -e866348]ti[-e866348]tution[+e866343 -e866348]nuance of such governments. Sec. 2. And be it further enacted, That the provisional governor and executive[-e866348]ral[+e866343 -e866348] council thus elected for each of said States [-e866348]which may be reconstructed under[+e866343 -e866348]shall, before entering upon the discharge of their official duties, take and subscribe the oa[-e866348]c[+e866343 -e866348]th of [-e866348]March[+e866343 -e866348]office prescribed by act of July 2, 186[-e866348]7,[+e866343 -e866348]2; and [-e866348]its supplem[+e866343 -e866348]the compen[-e866348]t[+e866343 -e866348]s[-e866348], m[+e866343 -e866348]a[-e866348]y at[+e866343 -e866348] eleven, on taking the oath prescribed by law[+e866346 -e866348] [+e866343 -e866348]the [+e866343]time[+e866343]on[-e866343] of voting upon th[+e866343]said governor and executive council shall b[-e866343]e rati[+e866343]fica[+e866343]xed by the conven[-e866343]tion and paid out [-e866343]of the constitution vote also for members of Congress, who[+e866343]State treasury. Sec. 3. And be it further enacted, That the governor[-e866343] shall be entitled to take their seats in[+e866343]have authority, by and with the advice and approval of a majority of[-e866343] the n[+e866343]ext session of Congress after[+e866343]ecutive council thus elected, to remove all persons from office in[-e866343] their re[-e866343]sp[-e866343]ecti[-e866343]veral[+e866343] States shall[+e866343]who[-e866343] have been admitted [+e866343]engaged in rebellion aga[-e866343]ins[-e866343]to[+e866343] the Union; and until a new apportionment[+e866343]ted States, or who have opposed[-e866343] the elec[+e866343]restora[-e866343]tion o[-e866343]for[+e866343] said memb[+e866343]States to their form[-e866343]er relation[-e866343]s shall be acc[+e866343]in the Union, or who have neglected [-e866343]or refuse[-e866343]ding[+e866343] to the districts as they existed in 1858[+e866343]ake the oath of office prescribed by act of July 2, 1862,[-e866343] and 1859, except whe[+e866343]to appoint i[-e866343]n o[+e866343]therwise provided for;[+e866343]ir stead loyal[-e866343] and compe[-e866343]th[+e866343]ent[-e866343] sa[+e866343]men,[-e866343] und[-e866343]er such ru[-e866343]lective officers who make[+e866343]s and regulations as[-e866343] the return of the votes cas[+e866343]convention may prescribe: Provided, Tha[-e866343]t all pers[-e866343]on the ratification or rej[+e866343]s appointed to office by the governor and ex[-e866343]ecu[-e866343]tion of the constitution shall enumerat[+e866343]ve council aforesaid, shall before entering upon the duties of any office, tak[-e866343]e and certify[+e866343]subscribe[-e866343] the v[+e866343]oa[-e866343]th pr[-e866343]escribed[-e866343] by a[-e866343]cas[+e866343]t for the members of Congress[+e866343]of July 2, 1862. Sec. 4. And be it further enacted[-e866343], That from [-e866343]and give certificates[+e866343]after the meeting and organization[-e866343] of elec[+e866343]the conven[-e866343]tion to those having[+e866343]s now authorized by law in either of[-e866343] the l[+e866343]afo[-e866343]rg[+e866343]est numb[+e866343]aid States, the authority given district command[-e866343]ers by act[-e866343] of votes[+e866343]July 19, 1867, to remove from[-e866343] and whom they may deem entitled t[+e866343]appoint to civil office any person in such States, is [-e866343]hereto[+e866343]by revoked[-e866343].

Sec. 3[+e866343]5[-e866343]. And be it further enacted, That so m[-e866343]uch of the act of March 23, 1867, suppleme[-e866343]ntil a new app[+e866343]ary to an act entitled “And act to provide f[-e866343]or [-e866343]the more eff[-e866343]icient g[-e866343]over[-e866343]nment shall be made of Re[+e866343]of the rebel States,” passed March 2, 1867, as [-e866343]provid[-e866343]esentatives South Carolina sh[+e866343] that, unless a majority of [-e866343]all be entitl[+e866343]the register[-e866343]ed elec[-e866343]to six Representatives, two of whom[+e866343]rs in each State shall vote “for a convention,” no convention[-e866343] shall be h[-e866343]electe[+e866343]d by general ticket; North Carolina eight Representatives, [+e866343]under said act, and so much of said act as requires a majority of the registered electors to vote for the ratificati[-e866343]on and acceptanc[-e866343]e of whom shall[+e866343]any constitution which may[-e866343] be elec[+e866343]framed and submit[-e866343]ted by general ticket; Georgia eight Representatives[+e866343]the conventions authorized in the act aforesaid[-e866343], as a c[-e866343]one of whom shall be elec[+e866343]dition to its being transmit[-e866343]ted by general ticket; Florida shall have one Rep[+e866343]the presiding officer of such convention to the P[-e866343]resid[-e866343]entative; Alabama eight, two of whom shall be elected by general ticket; Mississippi six, one of whom shall b[+e866343] of the United States, be, and the same is hereby repealed; and hereafter a majority of the electors in such of the States hereinbefore named who may vot[-e866343]e at any [-e866343]election authoriz[-e866343]ed by gen[+e866343]the sev[-e866343]eral. Ticket; Louisiana six, one[+e866343] acts aforesaid, shall be authority for the holding[-e866343] of whom shall be elected by gene[+e866343]such conventions as are therein provided for, and for the [-e866343]ral [+e866343]tif[-e866343]icket; Texas five, one of whom shall be[+e866343]ation of any constitution framed by such conventions and submitted to the qualified[-e866343] electors for th[-e866343]eir acceptance. Sec. 6. An[-e866343]d by general ticket; Arkansa[+e866343]e it further enacted, That all acts and parts of acts inconsistent with the provisions of thi[-e866343]s act be, and [-e866343]thr[+e866343]e sam[-e866343]e;[+e866343] and Virginia—[+e866343]re hereby, repealed[-e866343].
