ARTICLE XVI

LABOR

Section 1. The rights of labor shall have just protection through laws calculated [+e698009]to promote the industrial welfare of the S[+e698009]s[-e698009]tate. [-e698009]

Sec. 2. The L[+e698009]l[-e698009]egislature shall provide by law,[+e698009] for a B[+e698009]b[-e698009]oard of L[+e698009]l[-e698009]abor, C[+e698009]c[-e698009]onciliation and A[+e698009]a[-e698009]rbitration,[+e698009] which shall fairly represent the interests of both capital and labor. The B[+e698009]b[-e698009]oard shall perform duties,[+e698009] and receive compensation as prescribed by law.

Sec. 3. The L[+e698009]l[-e698009]egislature shall prohibit: [-e698009]

(1) The employment of women,[+e698009] or of [+e698009]children under the age of fourteen (14)[-e698009] years,[+e698009] in underground mines. [-e698009]

(2) The contracting of convict labor. [-e698009]

(3) The labor of convicts outside of [-e698009]prison grounds, except on public works under the direct control of the S[+e698009]s[-e698009]tate. [-e698009]

(4) The Legislature shall protect employees from [-e698009]political and commercial control of employees[+e698009]. [+e698009]

Sec. 4. The exchange of black [+e698009]lists by railroad companies,[+e698009] or other corporations,[+e698009] or[-e698009] associations or persons is forever [-e698009]prohibited.

Sec. 5. The right of action to recover damages for injuries resulting in death,[+e698009] shall never be abrogated, and the amount recoverable shall not be subject[+e698009]limited[-e698009] to any statutory limitations[-e698009]. [-e698009]

Sec. 6. Eight hours shall constitute a day's work on all works or undertakings carried on or aided by the State, County,[-e698009] or M[+e698009]m[-e698009]unicipal governments;[+e698009],[-e698009] and the Legislature shall pass laws to provide for the health and safety of employees in factories, smelters,[-e698009] and mines.

Sec. 7. [-e698009] The Legislature shall[-e698009], by appropriate legislation, shall[+e698009] provide for the enforcement of the provisions of this article.
