[Report of the Committee on Slave Trade and Navigation as Amended by the Convention]

Sect. 4. [No tax or duty shall be laid by the Legislature on articles exported from any State;] The migration or importation of such persons as the several States now existing shall think proper to admit, shall not be prohibited by the Legislature prior to the year 1808 — but a tax or duty may be imposed on such importation not exceeding ten dollars for each person.

Sect. 5. No capitation tax shall be laid, unless in proportion to the census herein before directed to be taken.
