Proposition on Changing County Lines, Creating New Counties and Removing County Seats [File No. 43]

Proposition for insertion in the Constitution, on changing county lines, creating new counties and removing county seats.

1. No portion of any county shall be stricken off and attached to another county or formed into a new county, unless two-thirds of the qualified electors of the Territory proposed to be out off voting on the question at a general election shall vote in favor of such division.

2. No county shall be reduced to an area of less than 400 square miles nor shall any new county be formed containing an … less than 400 square miles.

3. No territory shall be added to any organized county without the consent of the majority of the voters of the county to which it is proposed to be added. But the portion so stricken off and added to another county, or formed in whole or in part into a new county, shall be bound for it proportion of the indebtedness of the county from which it has been taken.

4. No county seat shall be removed unless upon a petition of one-third of the qualified electors of the county, and unless two-thirds of the qualified electors voting at a general election, shall decide in favor of such removal. A proposition for removal of a county seat shall not be submitted more than once in eight years.

No person shall vote at such election only those qualified to vote for territorial, county and precinct officers.
